What is the Drug and Alcohol Clearinghouse?

A: The Clearinghouse is a secure online database that will provide real-time information about a commercial driver's license (CDL) and commercial learner's permit (CLP) holder(s) drug and alcohol program violations.

What information will be contained in the Clearinghouse?

A: It will contain records of violations of drug and alcohol prohibition in 49 CFR Part 382, Subpart B, including:

  • Positive drug and/or alcohol test results
  • Refusals to test
  • Completed negative return-to-duty (RTD) tests
  • Completion of a follow-up testing plan
  • DUI citation in commercial motor vehicle (CMV)
  • DUI conviction in a commercial motor vehicle (CMV)

Who needs to register in the FMCSA Clearinghouse?

A:  The below are who will be required to register:

  • Owner-Operators
  • Commercial Driver's License (CDL) and Commercial Learner's Permit (CLP) holders
  • Employers
  • Consortia/Third Party Administrators (C/TPA)
  • Medical Review Officers (MROs)
  • Substance Abuse Professionals (SAPs)
  • Enforcement personnel​

How do I know if this affects my organization for registering?

A: If you have employees who have a commercial driver license (CDL) and operates a commercial motor vehicle on public roads than your organization will need to register.

Example:

  • School bus drivers
  • Waste management vehicles
  • Construction equipment operators
  • Truck drivers including passenger carriers

Does the FMCSA Clearinghouse final rule change any of the existing drug and alcohol program requirements in Part 40?

A: No, the final rule does not change any existing requirements in the U.S. Department of Transportation (DOT)-wide procedures for transportation workplace drug and alcohol testing.

If a donor tests positive and isn't registered in the clearinghouse how will the MRO post the verified positive in database?

A: The MRO will still enter in the verified positive and will be linked up to donor once they are registered in the FMCSA Clearinghouse.

How are the verified positive drug and alcohol results linked to employee?

A: They are automatically linked in the database by the employee's CDL number.

How do I purchase a query plan?

A: You can purchase your company's query plan on the FMCSA Clearinghouse website when registering. There are different tier levels for purchasing query plans.

How long will the Clearinghouse keep the employee violation records?

A: They will be held in the Clearinghouse database for up to 5 years from the date the violation was determined, or until the violation is completed successfully through the return-to-duty process and follow-up testing is completed, whichever is later.

 

How do we know if our company has successfully designated Info Cubic, LLC as our C/TPA?

A:  The Info Cubic, LLC designated admin in the FMCSA Clearinghouse will receive an email with your company name and will approve. Once our Admin approves your company, your admin will receive an email indicating your company has been approved.
