How can Info Cubic assist my organization in complying with the FCRA?

While it is important to note that Info Cubic cannot provide legal advice, we are happy to work as your partner to help educate you in compliance best practices in regard to background screening.  

As an Employer, there are many regulations of which you must be aware and in compliance with. For example, background checks for employment purposes (including those for independent contractors and volunteers) are governed by the Fair Credit Reporting Act (FCRA). Some states even have their own version of the FCRA which must be followed. Additionally, some states—and even cities—have fair-hiring laws, such as “ban-the-box” laws, restrictions on requesting salary information, and individual assessment requirements for Adverse Action. Not complying with these laws can put you and your company at risk for litigation, which can result in pretty severe monetary penalties 

All Info Cubic staff has obtained the FCRA Certification from the Professional Background Screeners Association (PBSA), of which Info Cubic is a proud, accredited member. This certification makes our staff uniquely qualified to help you maintain compliance with the ever-changing landscape of the FCRA and applicable state laws.  

At the time of implementation, we provide all new clients with a document called, “FCRA Guide for Employers”. This packet of helpful information contains sample disclosure and authorization forms, sample Adverse Action notices, and government-issued forms, such as “A Summary of Your Rights Under the Fair Credit Reporting Act” and “Remedying the Effects of Identity Theft”. You and your legal counsel may use the sample forms in this packet to help you create your own FCRA-required forms. 

Info Cubic also offers Adverse Action services to help you comply with the FCRA’s Adverse Action requirements.
